Timothy Brightbill Discusses Solar Trade Remedy Dispute with China

Wiley Rein International Trade partner Timothy C. Brightbill was quoted yesterday in a Law360 article about settlement talks requested by the Chinese government to resolve a trade dispute between U.S. and Chinese solar manufacturers.

It is unclear whether China has proposed an actual suspension agreement, said Mr. Brightbill, who represents SolarWorld in the dispute.  He said such agreements are rare in trade remedy cases, and noted that the filing of any settlement proposal would not change the fact that U.S. Customs officials are collecting preliminary antidumping duties on Chinese solar imports.

“There is no way to know whether an agreement will result,” Mr. Brightbill said.  “SolarWorld is open to any proposal that addresses all of China’s unfair trade practices and is enforceable.  We look forward to working with the U.S. government to ensure that any Chinese proposal meets those fundamental requirements.”
