Wiley Secures Unanimous Victory for U.S. Line Pipe Producers in ITC Sunset Review

In a victory for the domestic industry, Wiley, on behalf of the American Line Pipe Producers Association (ALPPA), a coalition of domestic line pipe producers, has secured an affirmative determination from the U.S. International Trade Commission (ITC) in the fourth sunset review of the antidumping order on certain welded large diameter line pipe (WLDLP) from Japan.

The ITC agreed with ALPPA and found that revocation of the order would lead to continuation or recurrence of material injury to the domestic line pipe industry within a reasonably foreseeable time, despite the Japanese industry’s arguments that subject producers had significantly reduced capacity and that the Section 232 tariffs on steel imports alone would limit unfairly traded Japanese imports. 

The ITC’s unanimous ruling leaves the dumping duties on Japanese WLDLP in place for at least another five years. “This order continues to be critical for limiting imports of Japanese line pipe at injurious prices, and we are pleased that the ITC recognized this in extending this important trade relief for domestic producers and their workers,” said Timothy C. Brightbill, counsel to ALPPA and co-chair of Wiley’s International Trade Practice.

This ruling falls closely behind the recent extension of trade relief on large diameter welded pipe from Canada, China, Greece, India, Korea, and Turkey, and the ITC’s affirmative determinations demonstrate that the U.S. antidumping and countervailing duty laws will be enforced to the full extent to prevent unfair trade. With the antidumping order secured, ALPPA will monitor for duty evasion, absorption, and circumvention, all of which are strictly illegal.
