Law360 Covers Wiley Rein Alert That GSA Backlog Could Delay Payments to Contractors

Wiley Rein’s recent Government Contracts Alert, warning that a backlog of unprocessed affidavits at the General Services Administration (GSA) could delay payouts to contractors, was the focus of a June 5 Law360 article.

The alert, System for Award Management (SAM) Affidavit Backlog Causing Payment Delays, was authored by Wiley Rein partner Tracye Winfrey Howard and associate George E. Petel. They explained that to minimize delays, each federal contractor should quickly submit an affidavit indicating who they have authorized to manage their SAM account.

The backlog occurred after a new GSA rule took effect in April 2018, requiring new and existing federal contractors to submit notarized affidavits naming their authorized account administrators. The GSA imposed the requirement in response to an investigation into alleged third-party fraudulent activity in the SAM system.

Wiley Rein’s alert urged businesses to submit their registration documents well in advance of their specified deadlines in order to give the GSA’s Federal Service Desk time to process it.
