Kathleen Cooperstein, special counsel in Wiley's White Collar Defense & Government Investigations Practice, spoke with The Baltimore Sun in the article, "Maryland defendants wait months for psychiatric care despite 10-day mandate," regarding an ongoing lawsuit against the Maryland Department of Health that alleges that defendants deemed incompetent to stand trial have been held in indefinite detention without due process.

Cooperstein, who represents Disability Rights Maryland in the case, said that, despite the financial challenges the state is facing, constitutional rights are “not contingent” on state budgets. She further noted that “the foundational right to due process is not so tenuous that it must erode in the face of financial challenges.”
