Megan Brown Quoted on Legal Implications of White House Cybersecurity Memo for Private Sector by POLITICO

Megan L. Brown, co-chair of the Privacy, Cyber & Data Governance Practice, was quoted by POLITICO's Morning Cybersecurity newsletter, "Trump’s private hacking plan raises legal alarms," regarding the potential legal implications of the White House's recent national cybersecurity memorandum for private companies.

“If there are mistakes or something goes wrong, it’s going to be challenging for [the administration] to come up with the right set of protections to get people comfortable doing this as participating companies,” said Brown, adding that the memo’s requirement for companies to post a $1 million bond to participate suggests the federal government may not step in to protect the companies involved if lawsuits are filed. “If the companies have to pony up some money,” then it’s unclear if DHS or DOJ plan to give them cover in the event of litigation, Brown noted.
