Scott Delacourt and Megan Brown Quoted in Coverage of Recent Data Privacy Decision by Eleventh Circuit

Scott D. Delacourt and Megan L. Brown, partners in Wiley Rein’s Privacy & Cybersecurity and Telecom, Media & Technology practices, were quoted in a July 31 article in The National Law Journal regarding a closely watched data privacy case. According to the article, the Federal Trade Commission (FTC) chose not to ask the U.S. Court of Appeals for the Eleventh Circuit to review its recent ruling in LabMD v. FTC, which “erased the agency’s enforcement action” against the medical testing company.

Mr. Delacourt and Ms. Brown predicted in June that the FTC would not press the LabMD case further in the Eleventh Circuit. “In light of the narrow scope of the Eleventh Circuit’s holding,” the attorneys wrote, “such further appeal may be unattractive to the FTC.”
