Jan Baran Discusses Super PAC Options After a Candidate’s Exit

Jan Witold Baran, co-chair of Wiley Rein’s Election Law & Government Ethics Practice, was quoted in a segment that aired today on Marketplace about what happens to super political action committee (PAC) money intended to support candidates no longer in the race for president.

Following their losses in the Iowa caucus last night, Martin O’Malley and Mike Huckabee announced that they would suspend their respective campaigns for president. The super PACs supporting those candidates have few restrictions on what they can do with the funds.

“What they can do with the money is return it to contributors,” Mr. Baran said. He added that’s exactly what happened when Rick Perry dropped out of the Republication presidential contest last fall. “Virtually all of that money has been refunded to those people who made the donations to the super PAC in the first place,” Mr. Baran said.
