Jan Baran Quoted in Coverage of Alleged Payment to Stormy Daniels

Jan Witold Baran, co-chair of Wiley Rein’s Election Law & Government Ethics Practice, was quoted by Politico and CBC News in coverage of recent developments concerning a 2016 payment to Stormy Daniels – who once alleged she had an affair with President Trump. Mr. Baran said such a payment would not be subject to campaign finance laws.

“This is financing related to an intensely intimate personal matter, and the [campaign finance] laws don’t apply,” Mr. Baran told Politico. “There has to be some objective way to measure whether something is campaign-related. … There was a time people would keep their personal relations like this quiet because it would be death to them politically, but that isn’t the case anymore, obviously.”

Mr. Baran told CBC News it would be difficult to prove that the payment was related to campaign spending, as opposed to being an expenditure “that just happened while the guy happened to be a candidate.” For that reason, the payment was not subject to campaign finance reporting requirements, he said.

“You don’t have to report your alimony payments, do you? Or your mortgage payments? It has to be subject to campaign laws,” Mr. Baran said. “And if it’s not subject to the laws, it doesn’t have to be reported.”
