Erik Baptist Quoted in Coverage of Biden’s Plans for TSCA Risk Evaluations
Erik C. Baptist, partner in Wiley’s Environment & Product Regulation Practice, was quoted by Chemical Watch in a January 28 article about the U.S. Environmental Protection Agency’s (EPA) implementation of the amended Toxic Substances Control Act (TSCA) under President Biden.
As Chemical Watch noted, the Biden Administration has called for a reexamination of the final TSCA risk evaluation rule, which took effect in 2017. But Mr. Baptist said it remains to be seen whether the Biden Administration will use “significant bandwidth” to revise the risk evaluation rule.
Even if no changes are made to the rule, it still “contains flexibilities for the EPA administrator to implement how they are going to conduct risk evaluations,” Mr. Baptist said. The prior Administration used that flexibility to set aside certain conditions of use, but the new EPA leadership may reverse those policy decisions, he added.
