Erik Baptist Discusses TSCA Reporting Obligations
Erik C. Baptist, a partner in Wiley’s Environment & Product Regulation Practice, stated that companies are facing challenges to comply with a chemical data reporting rule under the Toxic Substances Control Act (TSCA) in an article published by Chemical Watch on July 27, 2021.
“TSCA reporting obligations are only going to get more rigorous and onerous as the program matures under the 2016 amendments. The threat of an EPA (U.S. Environmental Protection Agency) enforcement action always exists, and now NGOs (nongovernmental organizations) are bringing citizen suits to enforce these requirements,” said Mr. Baptist, who previously served as Deputy Assistant Administrator for Law and Policy at the EPA’s Office of Chemical Safety and Pollution Prevention. He also noted that the EPA’s external communications need improvement to avoid “ambiguity” and ensure companies know their obligations.
