Erik Baptist Discusses June 22 Deadline for EPA to Assess 10 Chemicals Under TSCA
Erik C. Baptist, a partner in Wiley’s Environment & Product Regulation Practice, was quoted yesterday in a Law360 article about the June 22 statutory deadline for the U.S. Environmental Protection Agency (EPA) to finalize risk evaluations for 10 priority chemicals, as required under the amended Toxic Substances Control Act (TSCA).
With June 22 fast approaching, Mr. Baptist said there’s been too much for the EPA to do to meet the deadline for assessing all 10 chemicals. Some of the evaluations “will probably slip because of COVID-19 issues, along with completely implementing the Ninth Circuit decision from last year,” he told Law360.
Under the Ninth Circuit’s November 2019 ruling, the EPA must consider outdated uses of a chemical when evaluating it for potential risks to human health or the environment.
