Eric Wang Discusses North Dakota Campaign Finance Ballot Measure in Local Radio Podcasts, KFYR Radio

Eric Wang, special counsel in Wiley Rein’s Election Law & Government Ethics Practice and a senior fellow at the Institute of Free Speech, made appearances on two radio podcasts in North Dakota, discussing a campaign finance initiative that will appear on the state’s November ballot.

Mr. Wang was interviewed by Rob Port on his Rob (re)Port Podcast on WDAY Radio on August 17 and by the hosts of the What’s on Your Mind? Podcast on KFYR Radio on August 22.

In the August 17 interview, Mr. Wang said the proposed statewide measure could raise First Amendment concerns. “It requires the state legislature to enact laws that ‘require public disclosure of the ultimate and true source of funds’ for any attempts to influence state elections or to influence state government action,” he said. “It’s unclear what the content of speech would be that would trigger these laws and, equally important, it’s unclear which exact source of funds would have to be publicly reported.”

Mr. Wang said news and commentary shows could be affected if the measure passes in November, “because those could be said to influence state elections or state government actions, and that raises the question of: Would shows’ advertising sources have to be publicly reported?”
