Dan Pickard Weighs In On CIT Ruling on Diamond Sawblades
Daniel B. Pickard, a partner in Wiley Rein’s International Trade Practice, was quoted in an article published yesterday in Law360 discussing the U.S. Court of International Trade (CIT) affirmation of a U.S. Department of Commerce’s amended assessment of antidumping duties imposed on Chinese diamond sawblades.
While the decision was a win for the Diamond Sawblades Manufacturers Coalition (DSMC), the judge refused to reexamine Commerce’s policy of targeted dumping. The dispute pits the DSMC against a consortium of Chinese producers, largely consisting of affiliates of Gang Yan Diamond Products Co.
“There have been a series of department and court decisions along these lines supporting the revocation of Gang Yan’s separate rate and the domestic industry is ready for the end of the litigation as to this issue,” Mr. Pickard said. “In regard to the targeted dumping analysis, the DSMC is currently exploring its options.”
