Dan Pickard Discusses CFIUS Review of Monsanto and Bayer Merger
Daniel B. Pickard, a partner in Wiley Rein’s International Trade Practice, was quoted in an article in CTFinancial News, discussing the antitrust and national security implications of the acquisition of U.S. agricultural company Monsanto by Germany’s Bayer AG. The article noted the potential merger would also require clearance by the Committee on Foreign Investment in the United States (CFIUS). According to the article, the combined firm would control about 32% of the global agriculture chemicals market.
“In light of the consolidation that’s gone on in this industry and the fact that food security is viewed by many as a national security issue it’s not unreasonable to see how this deal might be reviewed by CFIUS,” said Mr. Pickard.
