Wiley Rein Partner Analyzes Supreme Court Decisions in Wal-Mart v. Dukes and AEP v. Connecticut

Dukes, No. 10-277, the Court rejected the propriety of certification under Federal Rule of Civil Procedure 23 of a national class action alleging gender discrimination on behalf of 1.5 million female Wal-Mart employees nationwide. In AEP v. Connecticut, 10-174, a unanimous court turned away plaintiffs seeking to use public nuisance doctrine to obtain judicial orders compelling reductions in carbon dioxide emissions to stop or slow global warming.
