Tim Brightbill Discusses Use of Trade Cases to Combat Cyberhacking

Tim Brightbill, a partner in Wiley Rein’s International Trade Practice, was quoted in an article published yesterday in The New York Times about the idea of using trade remedy cases to deter cyberhacking by the Government of China.  In its ongoing trade case, SolarWorld Industries America Inc. has asked the Commerce Department to investigate China’s cyberhacking and potentially impose higher tariffs on imports of Chinese solar panels as a way to address and deter such cyberhacking.  “We think it is critically important that the Commerce Department set a precedent here and take a strong stand that it will not tolerate cyberhacking of U.S. companies that file trade cases,” Mr. Brightbill said.  “This is a way that the U.S. could actually make it hurt.”  To read the entire article, click here.
